Please read these terms carefully. By using Hamia, you agree to them. They include limits on our liability and how disputes are resolved.
These Terms of Service ("Terms") are an agreement between you and Hamia LLC ("Hamia," "we," "us," or "our"). They govern your use of hamia.io and our products (the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you use the Services on behalf of a business or other organization, you agree on its behalf and confirm you have authority to do so. If you do not agree, do not use the Services.
Hamia builds AI-powered products for businesses, creators, developers, teachers, and students, including Hamia Business Model, Hamia Studio, Hamia Manager, Hamia Education Model, Hamia Apps Model, Hamia API, and Hamia Pay. Some features may be in development or marked as coming soon; they are not part of the Services until they are available to you.
We are always improving the Services, so we may add, change, or remove features. If a change materially reduces what you have paid for, we will tell you in advance where reasonably possible. Hamia provides technology only. We do not run your business, and nothing in the Services is legal, financial, medical, or other professional advice.
You must be at least 13 years old to use the Services, and at least 18 to use them for a business. Additional age rules apply to Hamia Education Model, including parental consent for some students and no live video classes for anyone under 18, as described in our Privacy Policy.
You must give accurate information, keep your sign-in details secure, and tell us right away about any unauthorized use of your account. You are responsible for all activity under your account. One Hamia account works across every Hamia product you use.
Some Services are free and others are paid. The price, what a plan includes, any usage limits, how long a payment covers, and whether it renews are shown when you sign up or check out, and those details form part of these Terms. You agree to pay the fees for the plan you choose, plus any applicable taxes.
Free trials. Some Services offer a free trial for a limited time or with limited usage, as shown when you start it. When a trial ends or its limits are reached, the related features stop until you choose a paid plan. We may change or end trial offers at any time.
Usage limits. Plans may include limits, for example on the number of AI replies or classes. When you reach a limit, the related features stop until the limit resets or you change your plan.
Payments and refunds. Payments are handled by our payment providers and, in some countries, by our affiliated companies. Hamia Apps Model subscriptions are sold through our online reseller Paddle.com, which is the merchant of record for those orders and handles their billing, tax, and payment-related customer service; Paddle's buyer terms also apply to those purchases. Fees are non-refundable except as stated in our Refund Policy or where the law requires otherwise. Purchases such as class access and gift codes are confirmed at checkout and are subject to the same policy.
You keep ownership of the content you put into the Services, such as your business information, classes, websites, files, and messages ("Your Content"). You give Hamia a worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit Your Content only as needed to provide, secure, and improve the Services for you. This license ends when Your Content is deleted from the Services, except where it has been shared with others or we must keep it by law.
You are responsible for Your Content and confirm you have the rights and permissions needed to share it, including any personal information about your own customers or students. If you are a business, you are responsible for telling your customers how their information is used.
Many Services use artificial intelligence to generate text, voice, images, video, and other content ("Output"). AI can produce Output that is inaccurate, incomplete, or inappropriate, and similar requests may produce similar Output for other users. You are responsible for reviewing Output before relying on it or sharing it, and for how an AI assistant set up by you responds on your behalf. Subject to these Terms, you may use the Output you receive.
You must not use AI features to create content that is unlawful, harmful, deceptive, or that infringes anyone's rights, or to impersonate a real person without their consent.
Your use of the Services must follow our Usage Policy. In particular, you must not:
Teachers on Hamia Education Model must complete our verification process and are responsible for their classes, materials, and conduct with students. Teachers earn from the classes they sell, less Hamia's commission, on the payout terms shown in their teacher account. Students must follow their teachers' reasonable class rules and these Terms. Hamia may remove classes or content that breaks these Terms.
The Services may connect to services we do not control, such as messaging and social platforms you choose to connect and payment providers. Your use of those services is governed by their own terms, and Hamia is not responsible for them.
The Services, including their software, design, text, and trademarks, belong to Hamia or its licensors and are protected by law. We give you a limited, non-exclusive, non-transferable right to use the Services under these Terms. If you send us feedback or suggestions, we may use them without any obligation to you.
We respect intellectual property rights. If you believe content on the Services infringes your copyright, see our Copyright Policy for how to send a notice. We may remove content and close the accounts of repeat infringers.
You can stop using the Services and delete your account at any time in your account settings. We may suspend or end your access if you break these Terms or our Usage Policy, if we must do so by law, or to protect Hamia, our users, or others. Where reasonable, we will tell you first. Sections that by their nature should continue after termination, including those on content, disclaimers, liability, indemnity, and disputes, will continue to apply.
The Services are provided "as is" and "as available." To the fullest extent permitted by law, Hamia disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Services will be uninterrupted, error-free, or secure, or that Output will be accurate.
To the fullest extent permitted by law, Hamia will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the Services. Hamia's total liability for any claim relating to the Services is limited to the greater of the amount you paid Hamia in the 12 months before the claim and 100 U.S. dollars. Some places do not allow these limits, so they may not apply to you.
If you use the Services for a business, you will defend and indemnify Hamia against claims, losses, and costs arising from Your Content, your use of the Services, or your breach of these Terms or the law, except to the extent caused by Hamia.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws rules. Any dispute relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you and Hamia consent to their jurisdiction. Nothing in this section takes away rights you have under the consumer protection laws of the country where you live. Before starting a formal dispute, please contact us so we can try to resolve it informally.
We may update these Terms from time to time. If we make significant changes, we will tell you by email or with a notice on hamia.io before they take effect. If you keep using the Services after the changes take effect, you agree to the updated Terms.
These Terms, together with the policies they refer to, are the entire agreement between you and Hamia about the Services. If any part is found unenforceable, the rest stays in effect. If we do not enforce a right, we do not give it up. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition, or sale of assets. Neither party is responsible for delays caused by events beyond its reasonable control.
For questions about these Terms, email legal@hamia.io or write to Hamia LLC, 30 N Gould St Ste N, Sheridan, WY 82801, USA.
